The old woman who hit and killed Diya-Patel, 4, of Stoughton last month was shown to have never even hit her brakes. This is startling news seeing as how the crosswalk that the child was walking in was clearly visible at 375 feet away.
Ilse Horn was not at her indictment to hear these details. She did not show up because her license was revoked by the moter vehicle registry.
She has now been ordered for a pretrial conference on Aug. 6 and must show.
It has also been learned that Charles Gunther Horn, Horn’s late husband, was killed in 1992 when she fell asleep at the wheel and crashed.
Diya was with her grandfather and other siblings on the crosswalk when another car stopped to let them pass. Horn, driving a Camry, passed the stopped car on the right and ran straight into the girl – making her fly an astounding 62 feet into the air. She then drove another 70 feet passed the scene before finally stopping.
“There was no evidence of pre-impact or post-impact emergency braking from the Camry,” said Payton, noting investigators found the car had “no mechancial defects.” In addition, Payton said Horn passed “a large bright yellow crosswalk sign” some 85 feet before the crosswalk.

At 8:30am this morning, giant cornice pieces feel from the roof of the Northeastern University building crashing down onto the sidewalk below.
Fortunately, no one was hurt by this collapse even during this usually busy time of the day.
Steve Grady of North Andover was in the area when the collapse happened.
“I probably missed it by eight seconds….God was with me today.”
The building was evacuated to perform a thorough check on the structure just in case it was weakened by the collapse. Outbound traffic was also stopped as the road has been blocked off. Inbound lanes are still open on Huntington Avenue.
Green Line T service is now being resumed as an engineer for the train has made sure the vibrations from the train will not effect the building any further.
The building not only houses student apartments, but also a restaurant, store and office. It was having roof repairs done at the time of the collapse.
